Terms of Service
Last updated 2 October 2026 · Effective 9 September 2026
1. Who we are
ArkCRM is provided by ARKCRM (Pty) Ltd, registration number 2026/190089/07 ("ArkCRM", "we", "us"). You can reach us at info@arkcrm.co.za. These terms govern your use of the ArkCRM software and website.
2. What ArkCRM is
ArkCRM is a subscription software service for managing jobs, customers, quotes, invoices and automated customer messaging. It is aimed at service businesses operating in South Africa.
3. Accounts and eligibility
ArkCRM is intended for business use. You are responsible for the actions of the users you add to your account, and for keeping your account credentials, and those of your users, secure. Let us know immediately if you believe an account has been compromised.
4. Your data is yours
You own the customer and business data you put into ArkCRM. We process it only to run the service on your behalf. You can export your data at any time while your account is active or read-only.
5. Acceptable use
You may not use ArkCRM for any unlawful purpose. You may not send messages, via WhatsApp, SMS or email, to people who have not consented to receive them. You may not attempt to access another customer's data, or otherwise interfere with the service or other users.
6. Messaging
When ArkCRM sends messages on your behalf — appointment confirmations, reminders, invoices and the like — you are the sender of record. You are responsible for having a lawful basis to contact the people you message. Where messages are sent over WhatsApp, your use is also subject to Meta's own policies for that platform.
7. Fees and billing
ArkCRM is billed monthly, in South African Rand, according to the plan you choose. Reminders are included on every plan, subject to fair use. On the Growth plan, extra users above the number included are billed at R120 per month per user. On the Professional plan, users and pricing are agreed with you. ArkCRM is not VAT-registered and does not charge VAT on any invoice. Payments are processed by a third-party payment provider; ArkCRM does not store your card details.
8. Cancellation and refunds
Cancellation and refund terms are set out in full in our Cancellation Policy and Refund Policy, which form part of these terms.
9. Availability
ArkCRM is provided on a best-efforts basis. We do not guarantee uninterrupted availability or any particular uptime. Where practical, we will notify you in advance of planned maintenance that may affect the service.
10. Liability
To the fullest extent permitted by law, our liability to you under these terms is limited to the fees you paid in the 3 months preceding the claim. We are not liable for indirect or consequential loss. Nothing in these terms excludes any liability that cannot lawfully be excluded.
11. Changes to these terms
We may update these terms from time to time. If we do, we will notify you by email, and the change takes effect 14 days after that notice.
12. Governing law and disputes
These terms are governed by the law of South Africa. Any dispute arising from these terms or your use of ArkCRM is subject to the jurisdiction of the South African courts.
13. Effective date
These terms are effective from 9 September 2026.
